8. Your content
The documents and information you send, receive and store remain yours. You give us permission to handle them only as needed to provide JamFax, for example to transmit, store and display your faxes. You are responsible for having the right to send what you send. Faxes are deleted according to the retention setting you choose.
13. Dispute resolution and binding arbitration
When this section applies. It applies to accounts opened on or after October 24, 2026. For accounts opened before then, it takes effect 30 days after we email the account owner about it, as section 14 provides, and covers only disputes that arise after that. If you do not agree, you can cancel before it takes effect.
Contracting party
JamFax.com is a registered trade name of TKG Voice, LLC ("JamFax", "we", "us" or "our"), located at 17113 Miramar Parkway, Suite 117, Miramar, Florida 33027, United States.
Informal dispute resolution
Before starting arbitration, you and JamFax agree to try to resolve any dispute through good-faith discussion. The party raising the dispute must give written notice describing the dispute, the relevant account details and the relief requested.
Notices to JamFax must be sent to: TKG Voice, LLC d/b/a JamFax.com, Attn: Legal — Dispute Notice, 17113 Miramar Parkway, Suite 117, Miramar, Florida 33027, United States.
JamFax will send notices to the email or mailing address on your account. If the dispute is not resolved 30 days after the notice is received, either party may start arbitration. This does not prevent urgent applications for relief or filings needed to preserve a legal deadline.
Agreement to binding arbitration
Except as set out below, you and JamFax agree that disputes arising out of or relating to these terms, your account or the JamFax service will be resolved by binding arbitration rather than a trial before a judge or jury.
Covered disputes include claims about subscriptions, billing, payments, fax transmission or delivery, suspension or termination of service, and the handling of personal information, to the extent those claims may lawfully be arbitrated.
The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement. To the extent applicable and not preempted by federal law, Florida law applies without regard to its conflict-of-law rules. Mandatory protections that apply to you remain in force.
Administration and procedure
Arbitration will be administered by the American Arbitration Association ("AAA") before one neutral arbitrator under its applicable rules, including its Consumer Arbitration Rules where they apply. Information about the AAA's rules and filing procedures is at www.adr.org.
The arbitrator will be selected under the applicable AAA rules. Hearings may be held remotely, on written submissions where permitted, or in person as those rules provide. Any in-person location must comply with applicable consumer protections and reasonably accommodate the parties.
If the AAA is unable or unwilling to administer the dispute, the parties may agree on another administrator. If they cannot agree, either party may ask a court of competent jurisdiction for appropriate relief, including appointment of a substitute where the law permits. Nothing requires a substitute procedure that would remove mandatory consumer protections.
Fees, remedies and award
Filing, administrative and arbitrator fees will be allocated under the applicable AAA rules and fee schedule, subject to applicable law. JamFax will pay all fees it is required to bear under those rules or the law. Available fee-waiver procedures continue to apply.
Each party bears its own legal expenses unless applicable law or an enforceable agreement permits an award of those expenses. The arbitrator may grant any relief available under applicable law for the claim presented and will issue a reasoned written award.
Judgment on the award may be entered in a court of competent jurisdiction, subject to applicable rights of judicial review.
No class or representative actions
You and JamFax may bring claims against each other only individually, and not as a plaintiff or class member in any class, collective or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of class, collective or representative proceeding, and may award relief only in favour of the individual party seeking it and only to the extent needed for that party's individual claim. If this paragraph is found unenforceable for a particular claim, that claim (and only that claim) must be severed and brought in court, not in arbitration.
Exceptions and protected rights
Either party may bring an eligible claim in small-claims court while the claim stays within that court's jurisdiction. Either party may also seek temporary or preliminary protective relief from a court of competent jurisdiction without waiving arbitration of the underlying dispute.
Nothing in this section prevents you from contacting, filing a complaint with or cooperating with a consumer-protection agency, data-protection authority, telecommunications regulator, law-enforcement agency or other government body.
This section does not require arbitration of claims that applicable law excludes from mandatory arbitration, or restrict any right or remedy that cannot lawfully be waived.
Court determination and severability
A court of competent jurisdiction will decide disputes about the formation or existence of this arbitration agreement and any other question that applicable law requires a court to decide.
If a provision is held unenforceable, it will be severed to the extent the law permits. If arbitration cannot lawfully be required for a particular claim, that claim may proceed in court. Any claim that proceeds in court, including small claims, will be brought in the state courts of Broward County, Florida, at the South Regional Courthouse, 3550 Hollywood Boulevard, Hollywood, Florida 33021, or in the federal courts for that district, and you and JamFax consent to their jurisdiction.
Survival
This arbitration agreement survives account closure and the end of these terms, but applies only where the parties have validly agreed to it. Account closure does not create a new agreement to arbitrate or widen an existing one.
